Joint PRCBC and Amnesty UK Briefing on 'Why legal advice, assistance and representation on British citizenship rights should be brought back within scope of Legal Aid', June 2025

This joint briefing was provided to the Ministry of Justice and Legal Aid Agency in June 2025 following a meeting in 2024 between MoJ and LAA officials, PRCBC and Amnesty UK to discuss the matter of legal aid provision for people with rights to British citizenship.

The briefing summarises the origins of the present civil legal aid scheme established under the Legal Aid, Sentencing and Punishment of Offenders Act 2012, which followed a consultation on civil legal aid in 2010-2011.

As explained in the briefing, had any or proper attention been given to rights to British citizenship when that scheme was established (or subsequently), these rights would be within legal aid scope (as they were previously). That is shown by considering the principles and purposes that were and are intended to underpin the civil legal aid scheme and how these clearly relate to rights to British citizenship (which were overlooked or misunderstood at the time that scheme was founded.
