Amnesty UK briefing on New Clause (Determination of Asylum Claims)

Overview

New Clause (118) is a probing amendment. It will enable debate and questions to ministers concerning the sharp decline of grant rates in asylum decisions made since the current administration took office. That decline is significantly done to the Nationality and Borders Act 2022 (NABA 2022), particularly its provisions that directly concern asylum decision-making.

The briefing explains this impact of the NABA 2022 and its appalling consequences for both refugees and any notion of good administration. The briefing suggestions questions that might usefully be put to ministers about this. It shows how this is all relevant to a wider concern that Amnesty has clearly expressed before and since the introduction of this Bill that a policy of failing or refusing to manage a fair and efficient system for managing asylum responsibilities is legally, morally and practically bad.

The Government should, accordingly, extend the repeals that are included within the Bill to encompass much of the NABA 2022 (including its asylum provisions).
