Rules
- The following rules ("these Rules") apply to the 'World's Shortest Gig' talent competition (the "Competition"). You can print off these Rules or save them for future reference. By entering the Competition, and/or by voting for the winner, you agree to be bound by these Rules. If you do not agree to these Rules, you cannot enter the Competition or vote in the Competition.
- The Competition is operated by Amnesty Freestyle Ltd ('Promoter'). The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you will be providing your information to the Promoter and not to Facebook. By entering the Competition you agree to release Facebook completely from all liability relating to the Competition. Any question, comments or complaints regarding the Competition should be directed to the Promoter and not to Facebook.
- The Competition is open to residents of the United Kingdom aged 18 or over.
- Employees of the Promoter, its associated entities or companies and families of the above are not eligible for the Competition.
- You are not eligible to enter the Competition if you are under contract with any film, record company or publishing company, or any other party which might interfere with your ability to create your Submission and grant the rights in relation to your Submission which are provided for in these Rules or, as a winner, to perform for the Promoter, grant rights in any performance given by you as a winner or to enter into agreements with the Promoter as described in these Rules.
- Entrants must also comply with the Facebook terms and conditions, a copy of which may be found at www.facebook.com/promotions_guidelines.php
- No sum is charged for entry into the Competition (except normal costs of internet access, telecommunications and telecommunications equipment).
- The period for entry into the Competition is from 12.00 GMT 8th February to 15.00 GMT 20th February 2012, inclusive of both dates, All entries must be received within the Competition period.
- To enter the Competition you must provide your full name, email address and phone number. We will use these details to notify you if you win, and may require you to provide further details to make prize arrangements. We will not use your details for any other reason without your consent, unless we are required or permitted to do by law. We will offer you (whether you win or not) the opportunity to receive notifications of future competitions and/or products that may be of interest to you. You have the right not to receive such notifications at any time.
- If you provide a false name or other details, including a name by which you are not usually known, this will disqualify you.
- To take part in the Competition, eligible entrants must submit to the Competition Facebook page a live original performance sample of your own original content of no more than 15 seconds length, performed solely by the entrant (the 'Submission'). Entrants will need to have a You Tube account on order to enter a Submission. The entrant must be the only person who appears in, works on and creates content for the Submission. In addition, entrants must not have been involved in the comedy circuit for more than 5 years.
- Submissions must not have won any prize or award or have been broadcast on TV or in the cinema prior to the Competition.
- Submissions (and any Prize performance) must not infringe the copyright or other intellectual property rights of any third parties or reveal any confidential information about any third party. Where you have uploaded a Submission to the Competition Facebook page, you will be responsible for any losses and costs the Promoter may have resulting from a claim by a third party that there has been an infringement of their intellectual property rights in the Submission.
- Submissions (and any Prize performance) must not contain any material which: (a) is sexually explicit, indecent, obscene, unnecessarily violent, defamatory or otherwise unlawful; (b) is derogatory or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, sexual orientation, disability, religion or belief, nationality, or age; (c) invades the privacy or publicity rights of any person, living or deceased; (d) is unlawful; or (e) is disparaging to the Promoter or is inconsistent with the positive images and/or goodwill with which Promoter wishes to be associated.
- The Promoter reserves the right to disqualify any Submission that it believes does not comply with the Rules in its sole and absolute discretion. If a Submission is reported to the Promoter as offensive on more than 3 occasions it will be automatically removed unless the Promoter in its sole discretion decides to reinstate it.
- By submitting a Submission, each entrant grants to Promoter an irrevocable, royalty-free exclusive licence in perpetuity to use, make available and otherwise exploit the Submission in any way and for any purpose including (without limitation) displaying and distributing, and permitting others to judge, the Submission on the Facebook page of the Competition and for advertising, trade and promotional purposes, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
- Each entrant also grants permission for the Promoter and its designees to use his/her name, photograph, voice and/or likeness and other personal information in connection with the Competition, the Prize performance, any film, recording, broadcast or webcast which is made of the Prize performance, any exploitation by any means of such film or recording, and for advertising, trade and promotional purposes without further payment, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
- Entrants agree not to issue any publicity concerning the Competition, the Submission, the Prize performance, or the Promoter.
- Entrants agree that neither the Promoter, nor its agents, shall be responsible for return or preservation of any Submission.
- Submissions will be competing against all other Submissions received from entrants from the United Kingdom. All Submissions will be initially reviewed by a team of industry experts assembled by the Promoter, based on the overall artistic merit of each Submission, to arrive at a set of finalists (a maximum of 5), whose Submissions will be made available for voting on the Facebook page of the Competition. The Competition winner will be chosen by the number of votes for each finalist from visitors to the Facebook page of the Competition (whether in or outside the United Kingdom). Voting will take place from 10.00 GMT on Thursday 23rd February to 17.00 GMT on Monday 27th February 2012, inclusive of both dates. All votes must be received within the voting period.
- To vote for the winning Submission, visitors to the Competition Facebook page must have an account with Facebook and accept the permissions required by the Competition application.
- Only one vote for any Submission may be made by any person. The use of any automated launching or entry software or any other mechanical or electronic means that permits visitors to the Competition Facebook page to vote repeatedly is prohibited. If the Promoter considers that any such means have been used, the votes concerned will be discounted.
- In the event of a tie resulting from the voting, the team of industry experts will determine the winner.
- The winner will be notified by email and mobile within 48 hours of the closing date of the Competition. The name of the winner will also be published on the Competition Facebook page at www.facebook.com/secretpoliceman
- Subject to the above, the Promoter's decision as to the winning entry is final and no correspondence will be entered into.
- The Prize is the opportunity for the winner to appear live on stage for 15 seconds at Amnesty International's Secret Policeman's Ball, at Radio City Music Hall, New York City on March 4th 2012 (the 'Show'). Further details of the Prize are as shown on the Competition Facebook page.
- As a condition of entering the Competition the winner grants the irrevocable right for the Promoter to (or authorise others to): (a) make an audio and/or audiovisual recording (the 'Recordings') of the winner's performance at the Show; (b) broadcast or webcast the winner's performance at the Show; and (c) exploit the Recordings (or any part or edited version of the Recordings) by any means and in any media in perpetuity (whether by way of broadcast, making it available on the internet or via mobile devices or on any DVD or other home viewing devices). However, there is no guarantee that the winner's performance will be recorded or included in any broadcast or webcast of the Show or that the Recordings will be included in any edits of any film or recording of the Show which are exploited in any way including by means of broadcast, DVD or otherwise. The winner must provide a script of the performance in advance.
- The winner must be available to travel to New York from Tuesday 28th February and return to the UK on Monday 5th March 2012. The winner must also be able to fulfil all US visa and other entry requirements. The Promoter may at its discretion substitute another finalist if the winner is not available for any reason.
- The Prize is for one person only and includes return trip economy airfare from a UK airport, transfers to hotel upon arrival and from hotel on return. Hotel accommodation includes continental breakfast and dinner.
- Transport to and from the airport in the UK, travel insurance, tax, surcharges, costs of passports and visas, and all other travel expenses are the responsibility of the winner. Travel arrangements will be made by the Promoter. No compensation will be offered if the winner cannot travel on the stated date for any reason.
- The winner is solely responsible for obtaining travel insurance (and all other forms of insurance) at his/her option. The winner may be required to provide a credit card at the time of hotel check-in. Travel is subject to the terms and conditions set forth by Promoter's transportation carrier(s) of choice.
- The winner will be responsible for his/her own safety in connection with the Prize, including travel, must be in good health and have no physical condition that would prevent him/her from travelling but the Promoter will in its discretion make alternative arrangements if you are not able to travel for health or disability reasons.
- No refund or compensation will be made in the event of the cancellation or delay of any transportation or other prize element except at the sole and absolute discretion of the Promoter.
- In the absence of negligence on the part of the Promoter, the Promoter will have no legal liability for any loss arising as a result of any circumstances beyond the control of the Promoter, or for any unforeseen losses or any business losses in connection with the Competition.
- There is no cash alternative and the Prize is not transferable. There are no second or other prizes.
- The winner will be required to take part in or co-operate with publicity, and to comply with all applicable rules relating to the performance venue.
- Personal information you provide in connection with the Competition will be transferred to and processed in the USA, where privacy laws may not provide the same level of protection as in the United Kingdom. By submitting your entry you consent to such transfer and processing.
- These Rules are governed by English law. If any disagreement arises out of them or the Competition that cannot be amicably resolved, and you wish to take court proceedings, you must do so within the United Kingdom.
